  1. Agreement

1. Agreement

1.1 You will be required to read, understand and agree to this full set of terms and conditions prior to starting the assessment

1.2 By clicking on the “I agree” button at the beginning of the assessment, you have expressed your full and unconditional agreement to these terms.

1.3 Should you disagree to any clause in this agreement, you are advised not to proceed with the assessment.

1.4 In the event that you click “I agree” and proceed with the assessment, you will have accepted all the clauses in this set of terms and conditions without recourse.


2.  5 Dimensions of the Growth Mindset

2.1 The 5 Dimensions of the Growth Mindset (“5DGM”) was created through research conducted by Growth Consulting & Training Pte Ltd, doing business as Growth Consulting Asia (“GCA”).

2.2 The research uncovered 5 fundamental drivers that contribute to one’s propensity to have a growth mindset (“GM”).

2.3 The GM is the result of research conducted by Dr. Carol Dweck (“Dweck”).

2.4 GCA does not represent the GM, Dweck, and all actors in relation to the GM.


3.  The Assessment

3.1  The 5 Dimensions of the Growth Mindset Assessment (the “Assessment”) was created by GCA to assess one’s propensity for the growth mindset in each of the 5 Dimensions.

3.2  All foreground and background intellectual property of the Assessment belongs to GCA.

3.3  The contents of the Assessment are based on research conducted by GCA over the course of 5 years from 2015 to 2019.

3.4  The assessment, interpretation, recommendations and conclusions of the Assessment report are the copyright of GCA and all rights are reserved.

3.5  The Assessment is intended for developmental purposes only and as stated in the Assessment report. This means that the Assessment is to guide training, coaching, on-the-job training (“OJT”) and organisational development decisions along a developmental culture.

3.6  The Assessment is not to be employed for performance measurement, recruitment, or for hiring and firing decisions.

3.7  GCA shall not be held responsible for any outcomes resulting from unintended use of the Assessment, including the misinterpretation or extended interpretation of the Assessment report.

3.8  Any interpretation of the Assessment report can only be done by a Certified 5 Dimensions Growth Mindset coach.

3.9  The results of the Growth Mindset Profile (“GMP”) in the Assessment are valid; that is to say, that it measures what it says to measure.

3.10 The results of the GMP are reliable to the extent that the Respondent is truthful and consistent in responding to the Assessment.

3.11 The output of the GMP has been verified by internal research processes.

3.12 The results of the Assessment have not been verified and validated by an external organisation.

3.13 The Optimal Profile (“OP”) and the Gap Analysis (“GA”) that are reflected in the detailed reports have not been validated by research.

3.14 The OP was created based on empirical and experiential data for best fit with typical executive behaviours on a focused model.

3.15 The OP may be subject to interpretation difference based on difference between the focused model and the typical executive behaviours.

3.16 The GA is obtained from the difference between the GMP and the OP. The reliability of the GA is dependent on the reliability of the GMP responses.


4. Intellectual Property

4.1  The Intellectual Property (“IP”) wholly and unconditionally belongs to GCA.

4.2  The IP is protected by copyright with effect from 2015.

4.3  By agreeing to this set of terms and conditions, you also agree that you will not transmit, analyse, deconstruct, copy, or recreate the algorithm or logic of the Assessment for any purpose.

4.4  You further agree that you will bear all legal costs that GCA will incur to defend the IP against any copyright infringement caused by your actions, whether willful or otherwise.

5. Limits of Liability

5.1  Notwithstanding paras 1.1 through 1.4, should there be a disagreement through the use of the Assessment, liability is limited to the cost of the Assessment.

6. Waiver

6.1  Failure or neglect by GCA to enforce at any time any of the provisions hereof shall not be construed nor shall be deemed to be a waiver of GCA's rights hereunder nor in any way affect the validity of the whole or any part of this Agreement nor prejudice the Licensor's rights to take subsequent action.


7. Severability

7.1  In the event that any of the terms, conditions or provisions contained in this Agreement shall be determined invalid, unlawful or unenforceable to any extent, such term, condition or provision shall be severed from the remaining terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law.


8. Governing Law and Jurisdiction

8.1  The agreement shall be governed by and construed in accordance with the laws of Singapore and the parties agree to submit to the exclusive jurisdiction of the Singapore courts.
